Terms of Service
These terms set out the agreement between you and Mesara for use of our service. Please read them together with our Privacy Policy.

Acceptance of these terms
By creating an account or using Mesara, you agree to these terms. If you are using Mesara for a business, you confirm that you are authorised to accept these terms on its behalf. If you do not agree, please do not use the service.
You are contracting with Mesara (Pvt) Ltd, a company registered in Sri Lanka under company number PV00369742, with its registered office at 26/A, Waboda Road, Negombo, Sri Lanka. In these terms, "Mesara", "we", "us" and "our" mean that company.
Our Acceptable Use policy and our Refunds and cancellation policy form part of these terms.

What Mesara provides
Mesara is software that helps you connect to the official WhatsApp Business Platform (Cloud API), run a team inbox, send messages within Meta's rules, and apply guardrails that protect your number. Mesara is sold as a subscription in Sri Lankan rupees. Mesara does not resell WhatsApp messages: those are charged to you by Meta on your own WhatsApp Business Account. Mesara is an independent service and is not owned by or affiliated with Meta. WhatsApp is a trademark of Meta Platforms, Inc.

Eligibility
You must be at least 18 years old and able to enter a binding contract to use Mesara. You must use the service only for a lawful business purpose.

Your account
You are responsible for keeping your login details safe and for everything done under your account, including by the team members you invite. Please give us accurate information and keep it up to date. Tell us promptly if you think your account has been used without your permission.

Acceptable use
When you use Mesara, you agree not to:
Send spam or bulk messages to people who have not agreed to hear from you.
Break the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, or any other Meta rules that apply to your account.
Send content that is unlawful, misleading, hateful, or harmful.
Try to bypass the guardrails, quality limits or rate controls built into the service.
Interfere with the security or normal running of the service.
You are responsible for having a lawful basis and consent to message your contacts. Breaking these rules can lead Meta to restrict your number, and can lead us to suspend or close your account. Our Acceptable Use policy sets out what is required, what is prohibited, and what happens if the rules are broken.

Subscription billing, message charges and refunds
Mesara is billed as a subscription in Sri Lankan rupees through our payment provider. The fee for your plan is shown on our pricing page and inside the app before you pay. Where a plan starts with a free trial, we take your card details when you sign up, we charge nothing during the trial, and the first payment is taken when the trial ends unless you cancel before then. Subscriptions renew automatically, monthly or annually depending on the plan you choose, until you cancel. We may change subscription prices, and we will tell you before a change applies to your account.
WhatsApp message charges are not ours to bill. You attach your own payment method to your own WhatsApp Business Account, and Meta charges you directly, in US dollars, at its published rates. Mesara does not resell messages and adds no margin to them. Any spend figure we show inside the app is an estimate for your information, not an invoice, and it may differ from what Meta charges you. Meta's rates, including the Sri Lanka rate changes taking effect on 1 October 2026, are set by Meta and can change without us.
You can cancel from your account at any time. Cancelling stops the next renewal and you keep your plan until the end of the period you have already paid for. Subscription fees for a period that has started are not refundable, except where our Refunds and cancellation policy provides otherwise, where the law requires it, or where we have charged you in genuine error. We cannot refund a charge that Meta made to your card.

Service availability
We work to keep Mesara available and reliable, but we do not promise that it will be uninterrupted or error free. We may carry out maintenance, and parts of the service depend on Meta and other providers that are outside our control.

Disclaimers
Mesara is provided on an "as is" and "as available" basis. Our guardrails are built to lower the risk of restrictions and bans, but Meta controls the WhatsApp platform and makes its own decisions. We cannot guarantee that Meta will never limit, restrict or ban your number, and we are not responsible for actions Meta takes on your account.

Limitation of liability
To the extent the law allows, Mesara is not liable for indirect or consequential loss, or for lost profits, revenue, data or goodwill. Our total liability to you for any claim connected with the service is limited to the amount you paid us for the service in the three months before the event that gave rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

Suspension and termination
You can stop using Mesara and close your account at any time. We may suspend or close your account if you break these terms, if your use puts other users or the platform at risk, or if we are required to by law or by Meta. Where it is reasonable to do so, we will let you know. On closure, the refund rules in section 6 apply.

Changes to these terms
We may update these terms as the product and the law change. When we make a material change, we will update the date at the top and, where appropriate, let you know inside the app. If you keep using Mesara after a change, you accept the updated terms.

Governing law
These terms are governed by the laws of Sri Lanka, and the courts of Sri Lanka have jurisdiction over any dispute connected with them.
